The Berry Hill Board of Commissioners adopted Ordinance No. 2017-435 on January 8, 2018. The ordinance amends the Berry Hill Community Development Code, the city's zoning ordinance, to establish regulations for short-term rental properties (STRPs).
Owner-occupied STRPs will be permitted throughout Berry Hill except in the zoning district that comprises Woodlawn Funeral Home and Memorial Gardens. In order to be considered owner-occupied, the owner must permanently reside in the property and occupy it a minimum of 243 days each calendar year. Non-owner-occupied STRPs are permitted in most of the city, excepting only the Woodlawn District and the Rosedale District, the city's only residential district, which contains less than five percent of the city's land area. The Board of Commissioners also passed Resolution No. 122-2018, stating that the City Manager should have discretion to allow previously operating non-owner-occupied STRPs in the Rosedale Residential Zone, a one-year wind-down period, to cease operation or convert to owner-occupied STRPs, as long as they operate within the other conditions applicable to permitted STRPs and new bookings.
Any person currently operating an STRP must apply for an STRP permit by February 28, 2018 and obtain the permit by March 31, 2018.
